Terms of Use — Last Courier

These Terms of Use (the “Terms”) govern your use of Last Courier (the “App”), an iPhone app developed and published by Osman Dogan (DGN Apps) (“we”, “us” or “our”). By downloading or using the App you agree to these Terms. If you do not agree, please do not use the App.

1. Who we are

Last Courier is published by Osman Dogan (DGN Apps), Istanbul, Republic of Türkiye. You can reach us at admin@dgnapps.space.

2. Who can use the App

  • You must be at least 13 years old to use the App.
  • If you are under the age of majority where you live, you may use the App only with the consent of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use of the App, including any purchases.

3. The App

Last Courier is a zombie-escape audio game you play while running or walking outdoors. A radio operator talks you through the story and a horde chases you based on your own pace. The App works on your iPhone without an account; your runs and game progress are stored on your device. How we handle information is described in our Privacy Policy.

4. Health and safety: please read

Running and walking are physical activities and carry a risk of injury. By using the App you accept that risk.

  • Not medical advice. The App is a game for fitness and entertainment. It does not provide medical advice, diagnosis or treatment, and it is not a training or rehabilitation programme.
  • Check with a doctor first if you have a heart condition, high blood pressure, are pregnant, are recovering from an injury or illness, or have any doubt about whether exercise is safe for you. Stop immediately if you feel pain, dizziness, shortness of breath or discomfort.
  • You are responsible for your surroundings. Watch where you are going, obey traffic laws and signals, use pavements and paths, and never run or walk where it is unsafe or not permitted. The game never requires you to cross a road, enter a place or keep moving.
  • The App never gives directions. Game events are tied to distance and time, not to turns or places. Your route is always your own choice.
  • Stopping always stops the chase. If you stop, the chase pauses and you lose nothing. You can pause or end a run at any time.
  • Keep your audio at a level that lets you hear traffic and people around you. Where available, use transparency mode or a single earbud, especially at night.
  • Never play in or on a vehicle. Do not use the App while driving, riding a bicycle, scooter or any other vehicle. The App pauses when it detects vehicle speeds.
  • Be visible. In the dark or in poor weather, wear reflective or bright clothing and use a light.

To the extent permitted by law, we are not responsible for injury, loss or damage resulting from your physical activity, your choice of route or your failure to follow these safety guidelines.

5. Free play and Courier Pass

Running is always free. The free version of the App includes the full chase engine, Free Run, Escape and Supply Run missions, Horde up to 20 minutes, story Episodes 0 to 3, the Safe House, levels and daily goals.

Courier Pass is an optional subscription that unlocks story Episodes 4 to 9, Weekly Ops, additional modes (Extraction and full-length Horde) and deep stats. Performance is never sold: there are no paid power-ups, experience points, resources or streak protection, no loot boxes and no advertising.

6. Subscription terms

  • Courier Pass is an auto-renewable subscription, available as a yearly plan and a monthly plan. The yearly plan includes a 7-day free trial for eligible new subscribers. The monthly plan has no trial.
  • Prices are shown in the App and on the App Store in your local currency before you confirm a purchase, and may include applicable taxes.
  • Payment is charged to your Apple Account when you confirm the purchase (or, for the yearly plan with a trial, when the trial ends).
  • Your subscription renews automatically at the same price and for the same period unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
  • You can manage or cancel your subscription at any time in Settings › [your name] › Subscriptions on your iPhone. Cancelling stops future renewals; you keep access until the end of the period you have paid for.
  • Any unused portion of a free trial is forfeited when you purchase a subscription.
  • Courier Pass supports Family Sharing: the subscriber can share it with up to five other family members through Apple’s Family Sharing.
  • Purchases are processed by Apple. Refunds are handled by Apple under its own policies; you can request one at reportaproblem.apple.com. We cannot issue refunds ourselves.
  • If the price of a subscription changes, Apple will notify you in advance as required by its rules, and where required, ask for your consent before the new price applies.
  • Use “Restore purchases” in the App to restore an active subscription on a new or reinstalled device signed in with the same Apple Account.

7. Virtual items and progress

Experience points, levels, resources, power-ups, Safe House upgrades and other in-game items are part of the game. They have no monetary value, cannot be exchanged for money or anything of value, and cannot be sold or transferred. Because your progress is stored on your device, it may be lost if you delete the App or reset your progress, and we cannot restore it.

8. Your licence and restrictions

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on Apple devices you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. You agree not to:

  • copy, modify, reverse-engineer, decompile or create derivative works of the App, except where the law expressly allows it;
  • extract, redistribute or resell the App’s audio, artwork, text or other content;
  • circumvent any technical or purchase restrictions, or use the App for any unlawful purpose.

9. Content and intellectual property

  • The App, its story, characters, artwork, sound and code are owned by us or our licensors and protected by intellectual property laws.
  • The radio operator’s voice is pre-recorded audio produced with synthetic voice technology; it is not a real person speaking to you.
  • The App’s typefaces are used under the SIL Open Font License 1.1; the licence texts are available in the App under Settings › Licenses.
  • Map data and map services are provided by Apple and its data providers and are subject to Apple’s terms. The “Legal” link on the map shows the applicable notices.

10. Apple Standard EULA

The App is licensed to you under Apple’s Licensed Application End User License Agreement (the “Standard EULA”), together with these Terms. If anything in these Terms conflicts with the Standard EULA, the Standard EULA prevails to the extent of the conflict. In addition, you acknowledge that:

  • These Terms are between you and us only, not with Apple Inc. (“Apple”). We, not Apple, are solely responsible for the App and its content.
  • Apple has no obligation to provide any maintenance or support services for the App.
  • If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
  • Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession or use of it, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims under consumer protection, privacy or similar legislation.
  • If a third party claims that the App or your possession and use of it infringes that third party’s intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
  • You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms, and once you accept them, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

11. Disclaimers

To the extent permitted by law, the App is provided “as is” and “as available”. We do not guarantee that the App will be uninterrupted or error-free, or that distance, pace, location or other measurements will be accurate. GPS and motion data can be affected by buildings, trees, tunnels, weather and your device.

12. Limitation of liability

To the extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages, or for loss of data or progress, arising from your use of the App. Our total liability for any claim relating to the App is limited to the amount you paid for the App and Courier Pass in the twelve months before the claim.

Nothing in these Terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, fraud, or gross negligence, and nothing in these Terms affects your statutory rights as a consumer under the laws of your country of residence, including consumer protection laws of the European Union and the Republic of Türkiye.

13. Privacy

We do not collect personal data. Your runs, routes and progress stay on your device. Please read our Privacy Policy for details.

14. Changes and termination

We may update the App and these Terms from time to time. If we make a material change, we will update this page and its effective date, and where appropriate let you know in the App. Continuing to use the App after a change means you accept the updated Terms. You can stop using the App at any time by deleting it. Your licence ends automatically if you breach these Terms.

15. Governing law

These Terms are governed by the laws of the Republic of Türkiye. The courts of Istanbul have jurisdiction over any dispute, without prejudice to any mandatory consumer protection laws of your country of residence and your right to bring proceedings in the courts of that country.
