These Terms of Service (“Terms”) govern your use of the DGN Apps mobile application and related services (the “Service”) operated by DGN Apps (“we”, “our”, “us”). By creating an account or using the Service, you agree to these Terms.
1. About the Service
DGN Apps is a platform that connects individuals seeking short-term and flexible work (“Workers”) with individuals and businesses offering such work (“Employers”). We provide the technology platform to facilitate these connections but are not a party to any agreement between Workers and Employers.
2. Eligibility
To use the Service, you must:
– Be at least 18 years of age
– Be legally permitted to work in the United Kingdom
– Provide accurate and truthful information during registration
– Not have been previously banned from the Service
3. Account Registration
You may register using your email address, Google Sign-In, or Apple Sign-In. You are responsible for:
– Maintaining the confidentiality of your account credentials
– All activities that occur under your account
– Notifying us immediately of any unauthorised use
We reserve the right to suspend or terminate accounts that violate these Terms.
4. User Types
4.1 Workers
As a Worker, you may:
– Browse and apply for available jobs
– Communicate with Employers through in-app messaging
– Receive and manage job offers
– Receive ratings and reviews from Employers
– Receive push notifications about relevant opportunities
4.2 Employers
As an Employer, you may:
– Post job listings with descriptions, requirements, and compensation details
– Review and respond to applications
– Communicate with Workers through in-app messaging
– Rate and review Workers after job completion
– Receive push notifications about applications and messages
5. Job Listings and Applications
– Employers are responsible for the accuracy of job listings, including compensation, location, requirements, and working conditions
– Job listings must comply with all applicable UK employment laws, including the National Minimum Wage Act, Working Time Regulations, and Equality Act 2010
– Workers acknowledge that applying for a job does not guarantee employment
– Any agreement between a Worker and an Employer is solely between those parties
6. Payments
– Payment terms, rates, and methods are agreed upon between Workers and Employers
– DGN Apps may facilitate payment processing but is not responsible for payment disputes between users
– All compensation must comply with UK minimum wage requirements
7. User Conduct
You agree not to:
– Provide false, misleading, or inaccurate information
– Harass, threaten, or discriminate against other users
– Use the Service for illegal activities
– Attempt to circumvent the platform to avoid fees or tracking
– Create multiple accounts or impersonate another person
– Upload offensive, harmful, or inappropriate content
– Interfere with the operation of the Service or its infrastructure
– Scrape, crawl, or collect data from the Service without permission
– Use automated systems or bots to interact with the Service
8. Content and Intellectual Property
8.1 Your Content
You retain ownership of content you submit (profile information, photos, job listings, reviews). By submitting content, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, and distribute that content as necessary to operate the Service.
8.2 Our Content
The Service, including its design, features, and branding, is owned by DGN Apps and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.
9. Reviews and Ratings
– Reviews and ratings must be honest, fair, and based on genuine experiences
– We reserve the right to remove reviews that are fraudulent, abusive, or violate these Terms
– Users may not offer incentives in exchange for positive reviews
– Once submitted, reviews cannot be edited but may be reported for policy violations
10. Push Notifications
By enabling push notifications, you consent to receive notifications about:
– New job opportunities matching your profile and preferences
– Messages from other users
– Application status updates
– Review and rating notifications
– Service announcements and updates
You may disable notifications at any time through the app settings or your device settings.
11. Photos and Media
– Users may upload profile photos and job-related images
– All uploaded content must be appropriate and relevant
– You must have the right to use any images you upload
– We may remove content that violates our guidelines without notice
– Uploaded images are stored securely and may be publicly visible to other users
12. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the Service, you acknowledge that you have read and understood our Privacy Policy.
13. Disclaimers
– The Service is provided “as is” and “as available” without warranties of any kind
– We do not guarantee the quality, safety, or legality of jobs posted on the platform
– We do not guarantee the qualifications, reliability, or conduct of any user
– We are not responsible for any loss, injury, or damage arising from interactions between users
– We do not guarantee uninterrupted or error-free operation of the Service
14. Limitation of Liability
To the maximum extent permitted by law:
– DGN Apps shall not be liable for indirect, incidental, special, or consequential damages
– Our total liability for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim
– Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law
15. Indemnification
You agree to indemnify and hold DGN Apps harmless from any claims, losses, or damages arising from:
– Your violation of these Terms
– Your use of the Service
– Content you submit to the Service
– Any dispute between you and another user
16. Termination
– You may delete your account at any time through the app settings
– We may suspend or terminate your account if you violate these Terms
– Upon termination, your right to use the Service ceases immediately
– Provisions that by their nature should survive termination will survive (including limitations of liability and indemnification)
17. Dispute Resolution
– These Terms are governed by the laws of England and Wales
– Disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales
– We encourage users to contact us first to resolve disputes informally at support@dgnapps.space
18. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes through the app or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree with the changes, you should stop using the Service and delete your account.
19. General
– If any provision of these Terms is found to be unenforceable, the remaining provisions remain in effect
– Our failure to enforce any right or provision does not constitute a waiver of that right
– These Terms constitute the entire agreement between you and DGN Apps regarding the Service
– You may not assign or transfer your rights under these Terms without our consent
